Land registration under a house / building
As is known, obtaining ownership of a house does not automatically lead to the emergence of ownership of the land. For this, there is a separate procedure for registering a land plot under a house / building, which involves preparing documents, interacting with state bodies and making the necessary changes to state registers. Consideration of this issue, as practice shows, is relevant for many property owners, so this article is designed to explore its main aspects.
What documents need to be prepared for a house / building?

The first thing to note: the procedure will not be possible without preliminary preparation of title documents. Their list may vary depending on the specific situation, but usually includes the original, notarized copies of:
- extract from the State Register of Real Rights to Real Estate (hereinafter – the State Register of Real Estate Rights);
- certificate of inheritance;
- court decision on the assignment of a house or building to the owner;
- technical passport for the house or BTI certificate.

Development of land management documentation
The next step is to order the development of land management documentation from a specialized land management organization. This document will serve as the basis for establishing the boundaries of the plot in nature.
Important: the person who performs the work of developing land management documentation must be a person who has a valid certificate of a land management engineer, information about which is entered into the relevant register of the State Geocadastre.
The development period should not exceed six months from the moment of signing the contract for the performance of work with the relevant organization.
Entering information into the State Land Cadastre
The next mandatory step is to enter information about the land plot into the State Land Cadastre (hereinafter referred to as the State Land Cadastre), in particular regarding its intended purpose, area, etc., assignment of a cadastral number.
To do this, you must contact the state cadastral registrar at the location of the land plot and submit:
- a statement of the established form;
- ready-made land management documentation;
- an electronic document containing information on the results of land management work.
After completing the procedure for entering information, the term of which by law cannot exceed fourteen days, the client receives an extract from the State Land Cadastre.
Registration of ownership of a land plot through the State Land Cadastre
This is followed by obtaining a decision from the local government body on approval of technical documentation and transfer of the land plot to private ownership to a citizen. This document is issued on the basis of the application submitted by the applicant and the attached package of documents.
After that, at the end of the procedure, it is necessary to carry out state registration of ownership. The ASN or notary enters the necessary information into the DRRP on the basis of correctly executed:
- application for state registration of ownership of land;
- copies of documents certifying the identity of the applicant (passport, his tax code) or the identity of his representative (power of attorney);
- copies of the decision of the relevant body on the transfer of the land plot;
- original extract of the State Land Registry;
- receipt for payment of the administrative fee for registration.
When (not) can a land plot under a house / building be registered?
It is necessary to comply with certain mandatory conditions, which include the following:
- the presence of a properly executed ownership right to a house or building, which must be registered in the Land Registry and confirmed by a corresponding extract or title documents;
- compliance of the intended purpose of the land plot with its actual use;
- absence of encumbrances on the land plot that prevent its transfer to private ownership.
