EBRD lending
The European Bank for Reconstruction and Development (EBRD) is one of the largest investors in Ukraine, playing a key role in financing projects that contribute to sustainable economic development. Through its lending programs, the bank supports businesses, government agencies, and local communities. Its goal is not only financial assistance, but also the implementation of modern standards of management, environmental, and social responsibility aimed at sustainable development. For a business seeking financing from this institution, it is important to clearly understand the legal features of working with the EBRD. This includes preparing documents, checking the terms of the contract, and resolving possible disputes.
What is the EBRD and why is it important for Ukraine?
The European Bank for Reconstruction and Development was founded in 1991 to support economic reforms in the countries of Central and Eastern Europe. Its activities cover more than 30 countries, including Ukraine, which is one of the largest recipients of financing. To date, the EBRD has financed 612 projects in Ukraine for a total of €20.73 billion. These projects cover key areas: infrastructure modernization, renewable energy development, support for small and medium-sized businesses, and the introduction of innovations. In the public sector, 12 projects are currently being implemented with a total loan volume of €2.395 billion, of which 52.23% has already been used. This indicates that a significant part of the financing is still waiting to be developed. For companies and government agencies planning to take advantage of the EBRD’s opportunities, it is critically important to have a clear action plan and professional legal support, as mistakes can lead to financial losses or slow down project implementation. How does EBRD lending work?
Key areas of financing
The EBRD actively supports projects that contribute to sustainable development, economic growth and the introduction of environmentally friendly technologies. The main areas of financing are:
Infrastructure projects: modernization of roads, railways, ports, airports and transport hubs to increase their efficiency.
Energy: support for projects in the field of renewable energy sources, including wind and solar power plants, as well as measures to improve energy efficiency.
Private sector: development of small and medium-sized businesses, financing of innovative startups through partnership programs with banks.
Agriculture: modernization of equipment, introduction of new technologies and expansion of the export potential of enterprises.
Financing conditions
EBRD lending involves a number of requirements, including: transparency of the company’s financial activities, readiness for audit, compliance with high standards of environmental and social responsibility. The bank conducts an individual assessment for each project, taking into account not only financial indicators, but also the potential impact on the environment and society. Therefore, it is important for companies to prepare high-quality business plans, feasibility studies and take into account the requirements of international standards. More information on lending requirements can be found in the EBRD Environmental and Social Policy Regulation.
Dispute Resolution with the EBRD
Despite favorable lending conditions, situations with various problems in cooperation are possible. Some of these are situations related to delays in loan payments, non-fulfillment of contract terms or violation of project implementation deadlines. There may also be differences in the interpretation of individual provisions of loan agreements, which creates conflict situations. In such cases, professional legal support becomes a decisive factor for the successful resolution of the dispute. The company “Prykhodko and Partners” provides services for pre-trial conflict resolution, helping to find a compromise between the parties. We also prepare claim documentation that meets all the requirements of Ukrainian legislation and EBRD standards, which ensures the legal validity of your position. Each case requires an individual approach, and our team ensures the most effective resolution of even the most complex legal issues in relations with the EBRD.
Legal support: why is it necessary?
Conclusion of agreements with the EBRD
Lending by an international bank is a complex procedure that requires knowledge and experience. Agreements with the EBRD have their own characteristics, including requirements for business transparency, detailed provisions on fines for violation of conditions and strict environmental standards. The company “Prykhodko and Partners” offers legal support, starting from the preparation of documents to the completion of the project. We carefully analyze each point of the agreement, ensuring that the terms comply with your interests and Ukrainian legislation. Proofreading and adjusting agreements is a key stage that will help avoid financial risks and legal conflicts in the future.

Is it possible to go through the bankruptcy procedure if the debt is less than 180,000 UAH?
Bankruptcy can be filed regardless of the amount of debt — there are no minimum limits set by law. However, if the amount of debt is less than UAH 180,000, it is usually more advisable to agree on debt restructuring, as bankruptcy may be economically unprofitable.
If I am not in Kyiv, can I cooperate with you?
Yes, we work remotely throughout Ukraine and even with clients abroad! We have many clients from Lviv, Odessa, Dnipro, Kharkiv, Cherkasy and other settlements.
Communication is carried out in any way convenient for you.
