Application for the payment of one-time cash assistance to military personnel

One-time assistance to military personnel is an issue that is often addressed to a military law lawyer. If you are interested in this topic and would like to receive qualified advice and assistance in writing an application for such assistance, pay attention to the services of the team at the Prikhodko & Partners law office. We specialize in military law, and this area of law is the focus of our practice. So we’ll be happy to help.

In what cases is one-time cash assistance paid?

Such assistance is provided in the following cases:

  • dismissal;
  • death or death of a military man (then his relatives receive help);
  • military disability or partial disability.

In addition, annual one-time cash assistance is provided to participants in hostilities and family members of those killed by May 5. The content of the application for payment of benefits, the accompanying package of documents and the authority to which it is submitted depends on what type of payment we are talking about.

One-time assistance upon dismissal

The payment of this assistance is regulated by Part 2 of Article 15 of the Law “On Social and Legal Protection of Military Personnel and Members of Their Families.” It applies to all military personnel, except conscripts discharged for health reasons. In this case, the serviceman will receive one-time assistance in the amount of 50 percent of his monthly allowance for each year of service. Only complete calendar years are referred to.

When it comes to dismissal due to age due to staff reduction, end of contract or organizational events, such assistance is paid if the military man has more than 10 years of service. The same applies to situations where a female soldier with a minor child retires.

One-time assistance in the event of the death or death of a military personnel

When it comes to the amount of payment in connection with the death or death of a military man, the amount of the benefit depends on the circumstances of the death. For example, if there was a death while performing combat missions, then assistance is provided in the form of 750 times the subsistence minimum, which is relevant for able-bodied persons as of January 1 of the calendar year. And if, for example, death occurs within a year after dismissal from service due to shell shock, accident, injury or illness related to service, then the family of the deceased is paid a benefit in the amount of 500 times the subsistence minimum.

To obtain such assistance, a fairly large list of documents is attached. Among them:

  • an application from each of the adult family members entitled to payment of assistance, as well as the second parent or guardian of the minor children of the deceased;
  • an extract from the order on the exclusion of a deceased or deceased military man from the military unit;
  • extract from the personal file about family composition.

In addition, the application must be accompanied by the military’s birth and death certificates, marriage certificate (if the wife or husband will receive assistance), and child’s birth certificate (if assistance will be provided for the child). This is not a complete list. As for the detailed list of documents required specifically in your situation, a lawyer will advise you.

One-time assistance in case of disability

If a military man becomes disabled while performing combat missions, the amount of payment will depend on the disability group. For example, when it is Group I, then 400 times the subsistence minimum is provided. If this is group II, then the serviceman will receive assistance in the amount of 300 times the subsistence minimum. And if we are talking about disability group III, then the serviceman will receive assistance in the amount of 250 times the subsistence minimum. Smaller amounts of payments are provided in the event that disability occurs due to an illness associated with military service.

Regarding the package of documents that is attached to the application for payment, this is a certified copy of the certificate of inspection of the MSEC, the resolution of the Internal High Commission, documents on the causes and circumstances of injury, injury or concussion. Our team of specialists will also guide you regarding other documents.
