Features of international registration of an invention

National patent in a specific country

In accordance with Article 37 of the Law of Ukraine of December 15, 1993 No. 3687-XII “On Protection of Rights to Inventions and Utility Models”, in order to submit a national application, it is necessary to first submit an application in Ukraine. One year after that, you can apply to the national office of the chosen country.

Regional Patent of the European Patent Office

The application to the EPO is submitted in one of the languages of the European Union (English, German, French) with an indication of the countries for patent protection.

From the moment of publication of the European patent, the owner receives the same rights as in the case of national patenting.

If desired, a Patent Cooperation Agreement can be concluded. This agreement can be applied to obtain national patents in 154 countries of the world, Eurasian and European patents.

Important: a European patent is not a guarantee that it will be valid on the territory of all European states. In order to obtain patent protection, it is necessary to carry out national validations in selected patent offices within 3 months from the moment of publication of the decision to issue a patent.
