Business visa to the USA

If you are interested in obtaining a US visa for business-related trips, you have come to the right place. The lawyers of the “Prikhodko & Partners” law firm are specialists who specialize in the field of migration law and can really effectively help you with such issues. We consult and provide support, thanks to which our clients successfully obtain a visa. We suggest considering this topic in more detail.

Selecting the purpose of the visa

The main visas for such cases are:

  • B1 – a visa for business trips. It is issued to those who need to travel to the United States for business negotiations, as well as to take part in conferences, sports competitions, professional and creative exhibitions. If you also need to periodically visit the United States for such purposes, this type of visa will be optimal for you.
  • B2 – a tourist visa. It is suitable for travelers who like to go to the United States for vacation, tourism or treatment. For those who intend to use medical services in the United States, but do not require long-term treatment, this visa may be appropriate. Often the visa is combined as B1/B2.

It is worth touching on the issue of the legal status that this visa opens in detail. It is not an immigration visa, and therefore does not give the right to work in the United States or study in this country.

The maximum period of stay on this visa is 6 months. As a rule, it is valid for 10 years. Thus, having obtained it, you can travel to the United States for a long time according to your business and tourist plans.

What should you know about the grounds for obtaining a visa?

To apply for this type of visa, you need to provide the following documents:

  • an invitation from an American company or event organizers (depending on the specific purpose of the trip);
  • a business plan or evidence of activity (sole proprietorship, LLC, taxes, accounts), since this is what confirms that you have real reasons for opening such a visa;
  • documents confirming the presence of strong ties with Ukraine (this may include evidence of family, property, and employment, since they will indicate that you do not intend to come to the United States and stay there illegally);
  • a package of documents.

Let’s look at the last point in more detail. The documents required to obtain this type of visa include:

  • a passport that is valid for at least 6 months beyond the planned trip;
  • completed DS-160 form;
  • 5×5 cm photo in accordance with US standards;
  • proof of payment of the consular fee (as of 2025, this amount is $185).

In addition, it is important to add documents justifying the trip: program, invitations, letters from companies.

What is the procedure for applying for a visa?

The first step is to fill out the DS-160 form online. It is important to do this correctly and also to save the completed document. Based on it, you will prepare for the interview. It is worth noting that the questionnaire is quite lengthy. It is better to fill it out together with your immigration lawyer, who will help you better understand the contents of the questionnaire. Next, you should sign up for an interview at the US Embassy (via ustraveldocs.com).

A personal interview at the embassy is a key stage. In order not to be nervous when communicating with an authorized representative of the consular office, you should properly prepare for this communication. When we provide support for such cases, we tell clients how they can confidently behave during the interview and what questions are most often asked. Knowing this in practice, we help them get their bearings better.

You may also find the following recommendations helpful:

  • Be concise and confident in your answers. Excessive detailing of plans is not appropriate unless the consular officer asks about it.
  • Avoid contradictory wording. Otherwise, your interlocutor may have doubts that the real purpose of the trip corresponds to the stated one.
  • Do not mention possible plans to stay in the United States, and also take a printout of the invitation, proof of income, and property certificate.

This way, you will be able to effectively communicate with the consular representative who is responsible for processing your visa.

What are the possible reasons for visa refusal?

Among the key reasons for refusal of a B1/B2 visa are:

  • lack of sufficient ties to Ukraine;
  • doubts about the veracity of the purpose of the trip;
  • discrepancies between the explanations in the DS-160 form and at the interview (this is why we recommend saving the completed form in order to prepare for communication at the consular office);
  • previous violations of the US or other countries’ visa regime;
  • any paid activity during the stay on a B1/B2 visa, since this is a violation of the conditions.
