Legalization of a farm is critically important for many reasons. Operating a farm without proper registration is illegal and can lead to fines and even demolition of illegally constructed facilities. Stages of legalization of a farm in Ukraine
Registration of ownership/lease of land under a farm

The very first step is to obtain the right to own or use a land plot under a future farm. This can be done in several ways:
- enter into a land lease agreement, superficies or emphytheusis (the most common option for starting a farm;.
- carry out free privatization of land for peasant farming (with changes made to the Land Code of Ukraine after the declaration of martial law);
- purchase of a plot of land or receiving it as an inheritance.
For a full-fledged registration, it is also necessary to perform a number of actions regarding the entry of information into the State Land Cadastre and the State Land Registry. In this case, an extract from the State Register of Rights to Immovable Property will serve as confirmation of the person’s possession of the relevant right.
Obtaining a permit for construction work
Before starting construction and the procedure for obtaining permits, it is worth determining which class of consequences for real estate objects your farm belongs to. For convenience, lawyers suggest focusing on the following instructions:
- Consequence class CC1 is suitable for small farms, where in the event of destruction, the number of people who can simultaneously be on the territory is insignificant; potential losses are small; there is no threat of environmental pollution outside the territory;
- Consequence class CC2 can be used for large farm complexes, where in the event of destruction, the losses will be significant and there is a risk of environmental problems beyond the boundaries of the relevant farm.
In general, to obtain a permit and begin construction, the applicant must order the development of project documentation and verify its compliance with state building standards, obtain a Master Plan of Construction, submit an application to the State Agency for Construction and Management of the State Construction Industry (DIAM) for a permit (for CC2 objects) or a notification of the performance of relevant construction works (for CC1 objects).
Commissioning a newly built farm
After the construction work is completed, the farm needs to be officially put into operation. This process involves:
- first, passing the technical inventory procedure (as a result, obtaining a technical passport for the building from the BTI);
- second, registering a declaration of readiness of the facility for operation (for SS1 facilities), drawing up a readiness certificate and issuing a certificate of conformity for the farm (for SS2 facilities).
Registration of a family farm as a completion of the legalization of the farm
Finally, the final step will be to register a legal entity or individual entrepreneur to run a family farm (hereinafter referred to as a family farm), if you plan to officially conduct business.
The advantages of registering a family farm are that:
- it is possible to be on a preferential single tax (4 groups);
- there is a possibility of receiving state support in the form of subsidies for bank loans, financial leasing agreements, and reimbursement of part of the VAT paid.

- The charter of a family farm;
- Minutes of the meeting of founders on the creation of a family farm;
- Application for state registration of a family farm;

Important! In addition to registering a family farm, the following specific documents may be required for the operation of the farm: permit for emissions of pollutants into the atmosphere, permit for special water use, environmental impact assessment, and others.
Requirements for registrants
A future farm must meet the following criteria:
- firstly, the activity must use the labor of an individual entrepreneur (the head of the farm) and family members only;
- secondly, the total area of agricultural land must be from 0.5 to 20 hectares;
- thirdly, the use of hired labor under employment contracts is prohibited (otherwise, another organizational and legal form for the farm is provided, such as a peasant farm);
- finally, the main activity must be growing agricultural products, breeding livestock, processing and selling produced products (as an exception, agri- and ecotourism activities can also be carried out on the farm).
