Case: We have prepared a legal opinion on the application of CMU Resolution № 634 in the aspect of leasing state and municipal property by diplomatic institutions
The Embassy of the Republic of Poland in Ukraine, located in Kyiv, contacted the law firm “Prіkhodko and Partners” with a request to obtain a written opinion on the application of the Resolution of the Cabinet of Ministers of Ukraine № 634 of May 27, 2022 “On the Peculiarities of Leasing State and Municipal Property during Martial Law” to legal relations related to the lease of state and municipal property by a diplomatic institution.
The essence of the issue
The Embassy of Poland in Ukraine required a legal assessment of whether the provisions of this resolution apply to diplomatic institutions, and what are the possible consequences of its application for current and future lease agreements.
Legal analysis and approach
The lawyer of the law firm Ogorodnyk Viktoriya conducted a comprehensive analysis of the regulatory framework, including international law regulating the activities of diplomatic missions, and Ukrainian legislation in the field of lease of state and municipal property. A detailed study of the norms of Resolution No. 634, the practice of its application, as well as the legal consequences for the lease relations of diplomatic institutions was carried out.
Result
Based on the results of the analysis, a written legal opinion was prepared, which provided clear explanations regarding the application of Resolution No. 634 to the lease relations of diplomatic institutions. Recommendations were also provided on further actions to minimize risks and protect the rights of the Embassy of Poland in Ukraine under martial law.
