On 09/13/2024, the client Olga Romanivna contacted us regarding the provision of the service of putting an unauthorized construction into operation.

The procedure for putting an unauthorized construction into operation

  • The first stage: analyzing the situation and identifying gaps in the cadastre

On September 18, we signed an agreement on the provision of legal assistance and received from the client the available documents for the land plot. During the visit of the technical inventory specialist, it turned out that the land plot was not included in the State Land Cadastre (SLC), which made it impossible to further register the house.

  • The second stage: searching and restoring documentation

On 09/19/2024, we discussed this problem and ways to solve it and came to the conclusion to find the land management documentation on the basis of which the state act was issued.

On 10/23/2024, we received a response from the State Land Management and Land Use Administration in Kyiv and Kyiv Oblast about the absence of this documentation in the local fund of land management and land valuation documentation and agreed with the client to develop technical documentation on land management regarding the establishment (restoration) of the boundaries of the land plot (on the ground).

On 12/19/2024, we found out about the presence of an overlay on the client’s land plot and formed a consolidated scheme for neighbors to sign the absence of claims and comments to the existing boundaries of actual use. We also made a publication in the newspaper to notify adjacent landowners (land users) about the work on fixing the boundaries of the land plot with boundary signs.

  • Third stage: entering data into the cadastre

On 01/30/2025, we submitted documents for registration with the State Land Registry, but received information from the registrar that the land plot was not included in the archival layer, therefore, on 02/12/2025, we submitted the client’s case to the State Land Registry in Kyiv and Kyiv region to enter this land plot into the archival layer, or to bring data about its compliance with the state act.

On 03/10/2025, we received a result from the State Land Registry in Kyiv and Kyiv region that the land plot was brought into compliance.

  • Fourth stage: legalization of unauthorized construction
  1. On 03/21/2025, we registered the land plot and received an extract from the State Land Registry.
  2. On 04/02/2025, we received a declaration of readiness for operation of the facility under amnesty.
  3. On 04/10/2025, all documents for the house and land plot were issued to the owner.

Result: unauthorized construction is legalized, the land plot is registered, documents are drawn up in accordance with current legislation.
