Case: A new lease agreement for a state-owned land plot has been concluded
Case
The client approached the law firm “Prikhodko and Partners” after the expiration of a land lease agreement that was used to service a commercial real estate property. The plot was state-owned, and the previous agreement was not extended under the terms specified in the contract.
Legal Support
The company’s lawyer, Angelina Ovsianko, implemented a set of measures to resolve the situation and ensure the client’s right to use the land plot under new conditions.
- Situation Audit and Document Preparation
- A detailed legal analysis of the situation was conducted. The terms of the previous lease agreement, provisions of current legislation regarding state land leases, and the Kyiv City Council’s requirements for lease agreements were studied.
- Based on the information obtained, it was determined that concluding a new agreement was the most appropriate solution for the client.
- The lawyer prepared a complete package of documents necessary for applying to the Kyiv City Council.
- Support at the Kyiv City Council
- The lawyer organized the submission of documents to the relevant KCC departments. This involved a series of communications with specialized experts of the city council.
- At all stages of consideration in the KCC committees and departments, the lawyer represented the client’s interests, ensuring timely responses to additional requests and requirements for documents or clarifications.
- Thanks to professional work, it was possible to ensure prompt consideration of the issue and the decision to lease the land plot for 10 years.
- Lease Agreement Conclusion
- Negotiations were conducted between the client and the Kyiv City Council regarding the terms of the agreement, including duration, rent amount, possibility of contract extension, and the client’s rights for further use of the plot.
- After agreeing on the terms, the contract was signed by the parties within the specified timeframe.
- Lease Agreement Registration
- The next stage was ensuring the state registration of the concluded lease agreement in the State Register of Property Rights to Real Estate (SRPRRE).
- Documents were submitted to the registrar, the review process was monitored, and an extract from the SRPRRE was obtained.
