On 09/18/2024, our client Natalia contacted us regarding the return of funds invested under the agreement on joint equity (share) participation in the construction of an apartment building.
The peculiarity of this case is that there was improper fulfillment of obligations by the other party – the Developer. In practice, it is difficult for clients to terminate the property rights purchase and sale agreement with the Developer on their own and return the funds actually paid.
In this situation, the lawyer had to analyze the terms of the agreement, advise the client on the procedure for terminating the agreement and the possibility of returning her funds, and represent the client’s interests during negotiations with the Developer. Therefore, the situation required the use of a comprehensive approach and the demonstration of professionalism by our specialist to promptly achieve the goal.

18.09.2024 We scheduled a preliminary meeting to sign the contract and discuss further actions. Previously, an analysis of case law was carried out and a detailed proofreading of the specified contract was conducted.
09.10.2024 A lawyer’s request was sent in order to obtain information about the reasons for non-fulfillment or improper fulfillment of obligations by the Developer Party under the contract.
15.10.2024 After receiving a response to the lawyer’s request and its detailed discussion, a decision was made to send a proposal to terminate the contract.
25.10.2024 Having received a response to the proposal to terminate the contract and having discussed it with the Client, we asked to provide a sample of the Termination Agreement.
02.12.2024 After negotiations with the Developer’s Representative and agreement on the terms of the Termination Agreement, we received its text and, in agreement with the Client, requested to schedule a meeting for signing.
25.12.2024 We successfully terminated the purchase and sale agreement of property rights for joint share participation in the construction of an apartment building and secured the return of the funds actually paid.
