Case: Secured the Discharge of a State Border Guard Service of Ukraine Serviceman on Family Grounds (Wife with a Group II Disability)
Service: Discharge from Military Service
A serviceman of the State Border Guard Service of Ukraine contacted Prikhodko & Partners Law Firm seeking legal assistance with his discharge from military service.
The client had a family-related ground for discharge provided by law: his wife has a Group II disability and, according to a medical report, requires constant assistance and care from another person. A particular feature of the case was that the serviceman was on leave at the time of his request. Therefore, one of the main objectives was to properly arrange his discharge and submit the necessary documents remotely, without losing time before his return to his place of service.
Client’s Situation
The Law of Ukraine “On Military Duty and Military Service” provides for the possibility of discharge from military service during martial law on family grounds, particularly due to the need to provide constant care for a spouse with a Group I or Group II disability.
In our client’s case, his right to discharge was supported by several documents: a registered marriage certificate, confirmation of his wife’s Group II disability, and a medical report confirming her need for constant assistance and care.
It was essential not only to establish the relevant family circumstances but also to properly document them and formulate the legal grounds for discharge in the military discharge request (report) in accordance with Ukrainian legislation.
Legal Support from Prikhodko & Partners
Our company’s military lawyer, Danylo Honcharenko, analyzed the serviceman’s circumstances and his wife’s documents and confirmed the existence of legal grounds for discharge from military service.
For the client, he:
- identified the appropriate legal grounds for discharge;
- prepared a formal military discharge request (report);
- compiled a complete package of supporting documents;
- reviewed documents confirming the marriage, disability status, and the wife’s need for constant care;
- arranged the remote submission of the discharge request and supporting documents to the relevant authority of the State Border Guard Service of Ukraine;
- provided legal support throughout the document review process and maintained communication until a positive result was achieved.
The discharge request, together with the complete package of supporting documents, was sent by post through Ukrposhta JSC while the serviceman was still on leave.
As a result, the client did not have to wait until his leave ended to initiate the discharge procedure. The documents were already being reviewed by the State Border Guard Service of Ukraine while the serviceman was away from his place of service.
Result
The discharge request and supporting documents prepared by the lawyer were accepted and reviewed by the State Border Guard Service of Ukraine.
Following the review, a decision was made to discharge the serviceman from military service on family grounds due to the need to provide constant care for his wife with a Group II disability.
By the time the client returned from leave to his place of service, the relevant discharge order had already been issued.
As a result, virtually the entire legal process — from assessing the grounds for discharge and preparing the request to compiling and submitting the documents — was completed remotely.
This case demonstrates that having legal grounds for discharge from military service is not always sufficient on its own. It is equally important to identify the correct legal provision, prepare a properly drafted discharge request, collect the necessary supporting documents, and choose the appropriate submission method.
