Case: Removed from the TCC wanted list and administrative case closed
Service: Removal from the TCC and SSC Wanted List
A person liable for military service contacted Prikhodko & Partners Law Firm after being placed on the wanted list by the Territorial Recruitment and Social Support Center (TCC and SSC) for allegedly failing to update his military registration information by July 16, 2024.
The client wanted to determine whether these actions were lawful and whether there were grounds for removing him from the wanted list without lengthy court proceedings.
What Did the Legal Analysis Reveal?
Danylo Honcharenko, a military law specialist at Prikhodko & Partners, thoroughly analyzed the client’s documents, the circumstances of the administrative case, and the statutory time limits for imposing administrative liability.
The analysis revealed that the TCC and SSC had missed the legally established deadline for imposing an administrative penalty.
Under Article 38 of the Code of Ukraine on Administrative Offenses, administrative penalties for violations of military registration and mobilization legislation under Articles 210 and 210-1 of the Code, committed during a special period, may be imposed within three months from the date the offense is detected, but no later than one year from the date it was committed.
In the client’s case, the statutory deadline had expired, providing grounds to request a review of the situation and the termination of further measures related to his wanted status.
Challenging the Wanted Status Without Going to Court
Following the legal analysis, our lawyer Danylo prepared a legally substantiated complaint directly to the relevant TCC and SSC.
In the complaint, the military law specialist outlined the chronology of events, substantiated the violation of the statutory time limits for imposing administrative liability on the client, and requested the termination of the wanted status and the closure of the administrative proceedings.
At this stage, an administrative approach was chosen to resolve the issue, allowing us to seek protection of the client’s rights without filing a lawsuit.
Result: Wanted Status Removed and Administrative Case Closed
After reviewing the complaint, the TCC and SSC issued a decision in favor of the client.
As a result:
- the client was removed from the TCC and SSC wanted list;
- the request to the National Police to locate and bring the client to the TCC and SSC was withdrawn;
- the administrative proceedings were closed.
Thus, the matter was fully resolved through administrative procedures without the need to go to court.
This case demonstrates that when a person is listed as wanted by the TCC and SSC, it is important to examine not only the reason for being placed on the wanted list but also when the alleged offense was detected, whether the statutory time limits for imposing administrative liability were observed, and which documents formed the basis for the request to the National Police.
