A conscript contacted our company with a request for legal assistance in obtaining a deferment based on paragraph 13 of part 1 of article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization”.

Clause 13 of Part 1 of Article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization” grants the right to a deferment to persons providing permanent care for sick relatives or persons in need of such care, subject to the availability of relevant supporting documents.
Documents required to apply for a deferment:
- Application for a deferment (in any form or according to the TCC sample).
Medical confirmation:
- Conclusion of the Medical Advisory Commission or the Medical and Social Expertise Commission on disability (Group I or confirmation of the need for constant care).
- Documents to confirm the family relationship (birth certificate or others).
- A certificate from the social security authorities that the person is providing care.
- A certificate from the State Registration of Civil Status Acts on the composition of the family or an act of inspection of material and living conditions.
- Documents confirming that other relatives cannot provide care (certificates of residence, absence, employment or disability of other relatives).
- Passport and identification code of the applicant
Submission procedure:
- Collected a full package of documents.
- Submitted an application with documents to the Dniprovskyi Territorial Recruitment Center (TСC).
- Waited for a decision from the TСC, but there was none.
- Sent a lawyer’s request to the TСC and eventually received a response about providing a deferment.
