Case: Successfully challenged the TCC wanted status related to a mobilization order and secured Its cancellation
Service: Removal from the TCC and SSC Wanted List
A person liable for military service contacted Prikhodko & Partners Law Firm after discovering information in the Reserve+ application indicating that he had been placed on the wanted list by the Territorial Recruitment and Social Support Center (TCC and SSC). The stated reason was the client’s alleged failure to report in response to a mobilization order.
This situation required particular attention, as a mobilization order is directly related to conscription and the assignment of a person liable for military service to active military duty. Under certain circumstances, intentional evasion of conscription during mobilization may result in criminal rather than administrative liability and may be classified under Article 336 of the Criminal Code of Ukraine.
Therefore, it was essential for the client to promptly verify the legality of the recorded information, the grounds for his wanted status, and whether the TCC and SSC had complied with the legally established procedures.
What Did the Legal Assistance Provided by Prikhodko & Partners Include?
Danylo Honcharenko, a military law specialist, analyzed the documents and established that the Territorial Recruitment and Social Support Center had missed the statutory deadline for imposing administrative liability on the client.
Initially, the lawyer contacted the relevant TCC and SSC directly and submitted a legally substantiated complaint requesting the removal of the client from the wanted list and the cancellation of the request to the National Police to locate and bring him to the TCC and SSC. However, no response to the complaint was received, and the client’s wanted status remained active.
The next step was therefore to initiate court proceedings. The military law specialist prepared a lawsuit and initiated judicial proceedings to challenge the actions of the TCC and SSC.
After the case had already been brought before the court, the TCC and SSC independently reviewed the situation and rectified the violations.
Result
Even before the court issued its decision:
- the client was removed from the TCC and SSC wanted list;
- the request to the National Police to locate and bring the client to the TCC and SSC was withdrawn;
- the TCC and SSC effectively complied with the demands raised by the client in his lawsuit.
Since the desired outcome had already been achieved, there was no longer any need to continue the court proceedings. As a result, the client was removed from the wanted list without having to wait for a final court judgment.
If you have been placed on the TCC and SSC wanted list, including for allegedly failing to report in response to a mobilization order, the first step should be to verify the legality of the grounds for your wanted status.
