Valentyn, a conscript, applied to the Law Office “Prikhodko & Partners” with a request to obtain a deferment from mobilization. During the initial consultation with the lawyer practicing military law, Danylo Goncharenko, it became clear that the client really had grounds to obtain a deferment, namely the presence of parents with disabilities. However, there was one important point – the client did not have a military registration document.
According to the legislation, the electronic military registration document generated in “Reserve +” should completely replace the physical document, but often employees of the CCC and SP neglect this rule and refuse to grant a deferment in the absence of a physical “soldier”.
The client was explained the action plan, a package of documents was drawn up and an agreement was concluded for submitting documents for a deferment.
According to the Law of Ukraine “On Mobilization Training and Mobilization”, the right to a deferment is granted to those persons who have one of their parents with a disability of group I or II, provided that there are no other persons who are not subject to military service and are obliged to support them by law. Both of the client’s parents were persons with a disability of group II.
It was decided for the convenience and safety of the client to submit an application for a deferment by mail. For this purpose, an application for a deferment of the established form was drawn up, and the package of documents was notarized.
It is important to notarize copies of documents, because ordinary copies may not be suitable.
In the package of documents, in the absence of a paper military registration document, an electronic military registration document generated in Reserve+ was included in the package of documents.
According to the Resolution of the Cabinet of Ministers of Ukraine № 560 “On Approval of the Procedure for Conducting the Call-up of Citizens for Military Service during Mobilization, for a Special Period”, a military registration document is a mandatory document when applying for a deferment; without it, it is possible to receive a refusal. Therefore, you must submit a physical draft document or an electronic draft document from “Reserve+”.
According to the information in “Reserve+”, on 01/20/2025, the client was granted a deferment from mobilization based on an application submitted by “Ukrposhta”.
Thus, the terms of the contract were fully fulfilled, and the client received a deferment from mobilization without going to the CCC and the Joint Venture.
