Cases related to legal support for the registration of a deferment from military service within the framework of mobilization occupy a large part of the total number of cases that the lawyers of the law firm “Prikhodko & Partners” work with. If you need professional legal assistance in such cases, you can contact us. But, before telling in detail about all the services that we provide, we suggest that you familiarize yourself with one of the recent examples of our work in such cases.
So, Dmytro, a conscript, who has grounds for a deferment from military service, has contacted us. We are talking about clause 13 of part 1 of article 23 of the Law of Ukraine “On Mobilization Training and Mobilization”. It establishes the right to a deferment for persons caring for a parent or spouse with a disability of group I or II. This clause stipulates that a conscript may receive a deferment if there are no other persons in the family who are not conscripts and have the obligation to care for a person with a disability.
At the time when Dmitry contacted us, he had an outdated registration certificate and an unupdated “Reserve+” application. To begin with, we conducted an initial consultation and analyzed all the circumstances of the case. This is what made it possible to see that Dmitry has the opportunity to issue a deferment on the specified grounds.
It is important to understand that having the right to a deferment does not equal a deferment. In order to exercise this right, it is necessary to provide the authorized representatives of the CCC and the SP with the entire package of documents confirming the existence of grounds for it.
For each of the grounds, a package of documents is provided for in the Annexes to the Cabinet of Ministers Resolution № 560. So, in the case of Dmitry, we helped to ensure that the package of documents was collected in full.
The next step was support in updating the military registration document. Since passing the VLK is a mandatory procedure, we provided Dmitry with support at the VLK. Such support from professional lawyers is a good choice for the client, as it makes it possible to monitor compliance with the law and record all real diagnoses. This protects against a situation where, having passed the VLK, a person in the documents becomes “healthier” than he actually is.
Next, we submitted a package of documents to the CCK and the SP together with an application. A response was received regarding a positive decision on a postponement. And the final stage was the submission of an application for entering information into the “Reserve+” application.
This is the sequence in which we worked with Dmitry on the issue of his deferment.
