Case: Secured the allocation of 15 million UAH in aid for the wife and child of a fallen serviceman
The family of a Ukrainian Armed Forces serviceman who was killed during martial law contacted Prikhodko & Partners Law Firm. Their main concern was obtaining the one-time financial assistance provided by the state to the families of fallen servicemen, particularly ensuring the child’s right to her entitled share of the payment.
After analyzing the circumstances of the serviceman’s death and reviewing the available documents, our lawyers established that the deceased serviceman’s wife and daughter had legal grounds to receive one-time financial assistance totaling UAH 15 million.
The main objective was to prepare the necessary documentation, ensure its processing by all authorized authorities, and obtain a positive decision from the commission of the Ministry of Defence of Ukraine.
What Made the Situation Complicated?
The procedure for obtaining one-time financial assistance following the death of a serviceman involves more than submitting an application to the Territorial Recruitment and Social Support Center (TRSSC). It also requires obtaining the necessary documents from the military unit, verifying relevant information, and subsequently forwarding the case materials to the Ministry of Defence of Ukraine.
Under paragraph 4 of Article 16-1 of the Law of Ukraine “On Social and Legal Protection of Servicemen and Members of Their Families” and paragraph 2 of Resolution No. 168 of the Cabinet of Ministers of Ukraine dated February 28, 2022, family members of a deceased serviceman are entitled to one-time financial assistance provided that the statutory requirements are met.
In this case, it was necessary to confirm the circumstances of the serviceman’s death, identify all individuals entitled to financial assistance, and ensure the proper preparation of documents for payments to his wife and child.
What Did the Legal Support Provided by Prikhodko & Partners Include?
Our senior military law specialist, Danylo Honcharenko, provided comprehensive legal assistance throughout the entire procedure, from preparing the initial request to obtaining the decision granting financial assistance:
- Conducted a legal review of the documents — examined the circumstances of the serviceman’s death, reviewed the available documentation, and identified the legal grounds for granting one-time financial assistance to his family members.
- Prepared the required documentation — drafted the necessary applications and collected documents confirming the rights of the deceased serviceman’s wife and daughter to receive their respective shares of financial assistance.
- Coordinated with the TRSSC and the military unit — assisted with submitting documents to the Territorial Recruitment and Social Support Center and contacting the military unit to obtain the necessary information.
- Monitored and supported the processing of documents by the authorized authorities.
- Secured a positive decision granting financial assistance — following the review of the submitted documents, the Ministry of Defence of Ukraine commission approved the payment of financial assistance to the deceased serviceman’s family.
Result: The Family Was Granted UAH 15 Million in Financial Assistance
The total amount of financial assistance granted was UAH 15,000,000, distributed between two beneficiaries:
- UAH 7,500,000 — to the wife;
- UAH 7,500,000 — to the daughter.
Thus, thanks to comprehensive legal support, the family obtained an official decision granting them the state financial assistance to which they were entitled.
Importantly, a positive decision granting UAH 15 million was secured in less than six months from the date the family contacted our law firm. For families of fallen servicemen, prolonged waiting periods for financial assistance are often among the most challenging aspects of the process.
This case demonstrates the importance of properly preparing documents and providing consistent legal support at every stage, from submitting an application to the TRSSC to having the case reviewed by the Ministry of Defence commission.
