Case: Successfully secured the military registration of a Ukrainian citizen residing abroad
A Ukrainian citizen who was born in Uzbekistan, permanently resides abroad, and has never been to Ukraine contacted Prikhodko & Partners Law Firm. Since the man had never been registered for military service, after logging into the Reserve+ application, he saw the status “Not Registered”.
Under current legislation, Ukrainian citizens who have never been registered for military service are, under certain conditions, subject to automatic military registration, including those residing abroad. However, this did not happen in our client’s case.
The main objective of our lawyers was to ensure the client’s military registration without requiring him to travel to Ukraine or visit a Territorial Recruitment and Social Support Center (TRSSC).
What Made the Situation Complicated?
The client was a Ukrainian citizen, but due to his permanent residence abroad and lack of previous military registration, information about his registration was not reflected in the Oberih register.
Initially, our senior military law specialist, Danylo Honcharenko, contacted the Territorial Recruitment and Social Support Center requesting that the military registration issue be resolved. However, the TRSSC rejected the request without resolving the matter on its merits.
At the same time, Resolution No. 1632 of the Cabinet of Ministers of Ukraine, dated December 5, 2025, provides a mechanism for the automatic military registration of male Ukrainian citizens aged 18 to 60 who have never previously been registered, including those residing abroad.
Since this mechanism did not work in the client’s case and the request to the TRSSC did not produce the necessary result, Danylo decided to protect the client’s interests through administrative court proceedings.
What Did the Legal Support Include?
To resolve the situation, our senior military law specialist, Danylo Honcharenko, carried out a comprehensive set of legal actions:
- Analyzed the client’s military registration status.
- Prepared and submitted a formal request to the TRSSC, substantiating the need to enter the client’s information into the Unified State Register of Conscripts, Persons Liable for Military Service, and Reservists.
- After receiving a refusal, prepared an administrative lawsuit against the TRSSC, seeking recognition of its failure to enter the relevant information as unlawful and an order requiring the authorities to register the client for military service with the status “Registered”.
- Provided legal representation in court proceedings — the administrative court opened proceedings based on the submitted lawsuit.
- After the court proceedings were initiated, obtained confirmation that the matter had been resolved: the client was registered for military service by the relevant military registration authority.
Thus, even before the court examined the merits of the case, the result for which the client had sought legal assistance was achieved.
Since the claims had effectively been satisfied, our lawyers submitted an application to the court requesting the closure of the proceedings.
Result: The Client Was Registered for Military Service Remotely from Abroad
Prikhodko & Partners Law Firm successfully secured the client’s military registration entirely remotely, without his personal presence and without the need to obtain a court judgment on the merits of the dispute.
As a result:
- The client, who was born and permanently resides abroad, was registered for military service by the TRSSC.
- The issue of entering the required military registration information was resolved.
- The client did not have to travel to Ukraine in person.
- The court proceedings were closed following the elimination of the contested violations and the successful achievement of the intended result.
This case demonstrates that even when automatic military registration does not take place and the TRSSC refuses to resolve the matter, Ukrainian citizens can protect their rights remotely, including through properly prepared formal requests and judicial appeals against administrative inaction.
