A client, a resident of Kyiv, contacted us with a problem regarding the forced detention of a conscript and coercion to undergo a military medical commission.
The Client was detained in the Solomianskyi district of Kyiv and forcibly taken to the Holosiivskyi DTCC and JV. During the verification of military registration documents, it was established that the Client is registered in the 1st department of the Buchanskyi DTCC and JV, which in itself indicates a violation of the established procedure by the part of officials.
Our military law lawyer urgently went to the place of detention. During the process, it turned out that the Client was allegedly wanted and was forcibly sent to undergo a military medical commission (MMC) at the Holosiivskyi DTCC and JV. At the scene, lawyer conducted an urgent legal consultation, conducted an initial legal analysis of the situation, checked the Client’s medical documents, and also discussed possible grounds for obtaining a postponement from mobilization.
Yulia provided the Client with a clear algorithm of behavior in the TCC and JV, explained his rights, the procedure for appealing against illegal actions, and emphasized the need to maintain calmness during any communications with representatives of military authorities.

Subsequently, the lawyer obtained official information about the circumstances of the client’s detention, and also properly prepared medical documents, which made it possible to reasonably substantiate the client’s position before representatives of the DTCC and JV, with references to the current regulatory legal acts of Ukraine — in particular, the Law of Ukraine “On military duty and military service”, Cabinet of Ministers Resolution № 402, as well as the provisions of the Constitution of Ukraine guaranteeing the inviolability of the person and the protection of citizens’ rights.
After submitting documents, providing a detailed legal justification, and pointing out violations of the detention procedure, lawyer Yulia Danilova held negotiations with representatives of the Holosiivskyi DTCC and JV. As a result of professional work and a strong legal position, the client was released, and further progress through the military medical commission was suspended until all documents were properly processed in accordance with the law.
