Case: Support for determining a critically important enterprise

An agricultural company contacted the company “Prikhodko & Partners” with a request regarding the possibility of determining critical for the functioning of the economy and ensuring the livelihood of the population in a special period.

A lawyer practicing military law, during the initial consultation, analyzed in detail:

  1. the business and economic activities of the enterprise;
  2. the agricultural land plots owned and used;
  3. the submitted tax reporting for the relevant period;
  4. the presence of arrears in the payment of taxes to the state and local budgets and a single contribution to mandatory state social insurance;
  5. the number of employees and the accrued average salary of insured persons – employees.

Based on the results of the initial consultation and the analysis of the company’s activities for compliance with the “CRITERIA AND PROCEDURE” approved by the Resolution of the Cabinet of Ministers of Ukraine dated January 27, 2023 № 76 and the Order of the Ministry of Agrarian Policy and Food of Ukraine dated December 10, 2024 № 4282, a strategy for further actions was developed and an Agreement on the provision of legal assistance was signed.

In order to determine the company as important for the national economy in the field of agriculture and critically important for the functioning of the economy and ensuring the livelihoods of the population in a special period with their inclusion in the Unified List for the Reservation of Military Conscripts-Employees and Ultimate Beneficial Owners, an application with supporting documents was prepared by the lawyer of the company “Prikhodko & Partners” to the Ministry of Agrarian Policy and Food of Ukraine.

After the application and a full list of supporting documents were formed, a submission was made through the State Agrarian Register. Within a month, DAR received a notification of approval of the submitted application.

 

In order to confirm the company’s compliance with the criteria specified in paragraph 2 of the “Criteria and Procedure”, determine them as critically important for the functioning of the economy and ensuring the life of the population in a special period and promptly enter information into the Unified List for the possibility of booking via the Diia Portal, a lawyer prepared a legal request.

As a result, a response was received from the Ministry of Agrarian Policy and Food of Ukraine on the decision to determine the LLC as critically important for the functioning of the economy and ensuring the life of the population in a special period with supporting documents (Order, Approved List) and entering information about the Company into the “Unified List” with the possibility of booking employees via the Diia Portal.
