Despite the fact that the legislation clearly regulates the issue of payment, in practice, the relatives of a serviceman often face the problem of bureaucracy and the human factor. And it is the intervention of a professional lawyer that makes it possible to influence the situation and move it from its place. What was the essence of the problem?
So, the mother of the fallen serviceman Mrs. Larisa turned to us. This happened in March 2024. During the previous 7 months, she could not receive payments. During the consultation, Ms. Larisa reported that she had submitted documents to the TCC and JV along with an application for payment of a one-time cash benefit. All this time, she was assured that the application was submitted to the Ministry of Defense of Ukraine, but it seems that her turn has not yet come.
How did we act?
First, we submitted a lawyer’s request to the TCC. From there, our team received an answer that, allegedly, documents confirming the connection between the death of a serviceman and the protection of the Motherland have not yet arrived from the military unit.
We continued to move forward and submitted a lawyer’s request to the military unit through the higher command and the General Staff in order to demand the documents of the act of official investigation and extract the order on the exclusion of the serviceman from the personnel.
After that, the military unit sent the documents to the RTCC and SP. Everything did not stop there.
What happened next?
We had to contact the TCC again. Therefore, the application along with the entire package of documents was submitted to the regional TCC.
After we sent a corresponding letter to the regional TCC, we received a reply that all documents from there were sent to the Ministry of Defense. And already in May, representatives of the IOU gave an answer to the fact that the mother of the deceased soldier is now really put in the queue for payments.
We did not stop and sent another letter to the MoU to speed up the payments. As a result, the funds were credited to Mrs. Larisa’s account in May. Since the benefit in connection with the death of a serviceman is paid gradually, Ms. Larisa currently has 1/5 of the total amount of payments.
How long did all the listed actions last?
As you have seen, our team had to do a whole system of well-thought-out actions to get things moving. It took 2 months. Considering the fact that there was no result at all before this, and Ms. Larisa received biased information about her situation for 7 months, such a result is significant.
When a loved one dies in war, this loss cannot be compared with anything. However, the state provides citizens with a number of guarantees regarding financial support for the families of servicemen who died defending the Motherland.
