Case: We challenged an education progression violation recorded in EDEBO and secured a new certificate for a mobilization deferment application
A student contacted Prikhodko & Partners Law Firm after encountering difficulties obtaining a mobilization deferment due to inaccurate information in the Unified State Electronic Database on Education (EDEBO).
When obtaining a certificate of enrollment, the man discovered that the document indicated a violation of the required sequence of educational attainment.
The main objective was to challenge the incorrect assessment of his education progression, prove that there was no violation, and secure a certificate containing accurate information.
What made the situation complex?
The client had previously studied for a bachelor’s degree at a higher education institution but had not completed the program and had been withdrawn from enrollment. He had therefore not received a diploma for that degree.
The man later decided to continue pursuing higher education. However, when generating his EDEBO certificate, the system took his earlier period of study into account and indicated a violation of the required sequence of educational attainment.
The problem was that incomplete studies had effectively been treated as a degree already obtained, although the client had not received the corresponding diploma.
This wording in the certificate had significant consequences, as compliance with the statutory sequence of educational attainment is important for students seeking a mobilization deferment.
It was therefore necessary to do more than correct the document: we needed legal confirmation that the earlier incomplete studies did not constitute a violation of the established sequence.
Legal support from Prikhodko & Partners Law Firm
Our senior lawyer for military matters, Danylo Honcharenko, began working on the case with a detailed analysis of the client’s educational history and the documents confirming the circumstances of his earlier studies.
He examined the EDEBO records, the grounds for the client’s withdrawal from his previous institution, the information confirming that no diploma had been obtained, and the documents relating to his current studies.
The lawyer paid particular attention to the statutory provisions defining education levels and the conditions for granting deferments to students.
The key legal position was that studying at a particular education level without completing the program and receiving the corresponding diploma does not, in itself, mean that the person has already attained that level of education.
As part of the legal support, Danylo Honcharenko:
- Analyzed the client’s educational history. Checked the documents concerning his previous studies, withdrawal from enrollment, and lack of a completed degree.
- Examined the reasons for the inaccurate EDEBO entry. Established which circumstances had led to the record indicating a violation of the required sequence of educational attainment.
- Developed a legal position. Substantiated why incomplete studies should not be equated with actually obtaining the corresponding degree.
- Prepared an administrative claim. Initiated a court challenge to the unlawful assessment of the client’s education progression.
- Provided legal support throughout the case. Presented the legal position and secured a favorable court decision.
During the court proceedings, it was demonstrated that the client had not previously obtained the relevant degree. The mere fact of his earlier studies and subsequent withdrawal therefore provided no grounds to consider the required education sequence violated.
The court accepted the arguments and ruled in the client’s favor.
Based on the court decision, we secured a new EDEBO certificate stating that the man had not violated the required sequence of educational attainment.
Outcome
Through the work of senior lawyer Danylo Honcharenko, we successfully challenged the inaccurate record of an education progression violation and obtained a new EDEBO certificate with the correct status: “No, does not violate.”
The client received a document confirming compliance with the required sequence of educational attainment. It can be used when applying for a mobilization deferment, provided that the other statutory requirements are met.
This case demonstrates that inaccurate EDEBO records are not final and can be challenged in court.
