Obtaining a deferment from mobilization due to the provision of ongoing care for a person who requires outside assistance is a legal basis under Article 23 of the Law of Ukraine “On mobilization preparation and mobilization”. In this case study, we will examine a practical example of obtaining a deferment through the registration of a care certificate.

Problem: The need to obtain a deferment from mobilization on the basis of providing ongoing care for a mother who, due to her health condition, requires outside assistance.

According to paragraph 9, part 1, article 23 of the Law of Ukraine “On mobilization preparation and mobilization”, conscripts are entitled to a deferment if they provide ongoing care to individuals who require such care, provided there are no other individuals capable of providing it.

In Oleg’s case, his mother required constant outside assistance due to her health, as confirmed by medical documents. The key task was to correctly formalize the conclusion of the medical advisory commission and obtain a certificate of care from the social welfare agency.

Stages of work

  1. Initial consultation and legal analysis

During the consultation the following was:

  • Oleg’s family situation and composition were analyzed;
  • the presence of other potential caregivers was verified;
  • medical documents were evaluated and an algorithm for obtaining a MAC opinion was determined;
  • clarification was provided on the procedure for further deferment.

  • the registration of documents and review deadlines have been monitored.

In case of additional requests, the social security agency promptly prepared the necessary explanations and documents.

Result: Oleg received a certificate of permanent care, which is the determining document for the deferment.

  1. Preparation of a package of documents for the Kyiv City TCC and JV

In accordance with the requirements of current legislation and Resolution of the Cabinet of Ministers № 560, the following was prepared:

  • application for a deferment;
  • act on the implementation of permanent care;
  • MAC report;
  • family composition documents;
  • the client’s military registration documents.

Lawyers supported the submission of documents to the Kyiv TCC and JV and ensured compliance with review deadlines.

  1. Receiving a decision and updating data

After reviewing the submitted documents, the Kyiv TCC and JV decided to grant Oleg a deferment from mobilization.
