Case: The status of a critically important enterprise was reconfirmed under the simplified procedure
Service: Reconfirmation of Critical Enterprise Status in 2026
A company operating in the field of building maintenance and residential infrastructure contacted Prikhodko & Partners Law Firm for legal assistance.
Our team had previously assisted this client in obtaining the status of a critically important enterprise. However, in 2026, due to changes in the rules governing critical enterprise status, it became necessary to undergo an additional review and confirm compliance with the updated requirements.
It was essential for the client to complete this procedure in a timely manner in order to prevent the critical enterprise status from being terminated and, consequently, to avoid risks related to the reservation of employees from mobilization.
Client’s situation
In 2026, Ukrainian legislation governing the designation of critically important enterprises was amended. In particular, Resolution of the Cabinet of Ministers of Ukraine No. 692 dated May 30, 2026 provided for the review of previously adopted decisions and required enterprises to confirm compliance with the updated requirements by September 1, 2026.
For companies that already held critically important enterprise status, this meant that they had to prepare the necessary documents and undergo the review procedure within the established deadline in order to retain their status.
Given the updated requirements, limited deadlines, and the need to properly confirm compliance with the applicable criteria, completing the procedure independently could have caused difficulties. Therefore, the client contacted us for document preparation and comprehensive legal support.
Legal support for reconfirmation of critically important enterprise status
Danilo Honcharenko, a military law attorney at Prikhodko & Partners, analyzed the client’s documents and assessed whether the company could retain its existing critically important enterprise status under the applicable review procedure.
The analysis confirmed that the company fully met the requirements necessary for such reconfirmation. Particular attention was paid to the average salary of employees, as compliance with the established salary threshold was a key factor for successfully completing the review.
As part of the procedure, the following documents were submitted:
- a certificate confirming the average accrued salary of insured persons employed by the company;
- a tax calculation of income accrued or paid to individuals, withheld taxes, and accrued unified social security contributions for the most recent calendar month;
- an application for confirmation of the status;
- other documents required for proper consideration of the application.
The military law attorney prepared the complete set of documents, verified their compliance with the applicable requirements, and prepared an application to the Ministry for Restoration, Infrastructure and Transport of Ukraine.
One of the advantages of this procedure was that the company did not have to prepare the entire set of documents again, as would normally be required when applying for critically important enterprise status for the first time.
Positive result
Following the review of the submitted documents, the company successfully completed the review procedure and confirmed its compliance with the applicable requirements. Thanks to the timely preparation of documents and professional legal support, the client retained its critically important enterprise status and was able to continue reserving employees liable for military service from mobilization.
If you need legal support regarding critically important enterprise status, the lawyers at Prikhodko & Partners will verify the validity of your current status, determine the necessary course of action, prepare documents for confirmation or re-obtaining critical enterprise status, and assist with communications with the relevant government authority.
