Case: We secured a court order for recalculation and payment of military pay arrears for 10 months of service
A serviceman contacted Prikhodko & Partners Law Firm because his military pay had been calculated incorrectly during his service.
The military unit calculated his position-based salary and military rank salary using a fixed amount of UAH 1,762, whereas the client had grounds to seek recalculation based on the subsistence minimum established for the relevant calendar year. This affected not only his basic salaries but also the additional payments calculated by reference to them.
The lawyers’ main objective was to secure recalculation of the serviceman’s military pay and payment of the amounts he had not received.
What made the situation complex?
When calculating military pay, the unit used the subsistence minimum as of January 1, 2018: UAH 1,762.
However, the subsistence minimum for persons of working age was:
- 2025 — UAH 3,028;
- 2026 — UAH 3,328.
Under Cabinet of Ministers Resolution No. 704, position-based salaries and military rank salaries are determined using the applicable pay-scale coefficients.
The client asked the military unit to recalculate his pay, but his request was refused.
How did the lawyer help resolve the problem?
Senior military lawyer Danylo Honcharenko analyzed the military pay calculation procedure and prepared a legal position to protect the client’s interests.
The legal support included the following steps:
- Analyzing the military pay calculations. Grounds were identified for seeking recalculation of the position-based salary and military rank salary.
- Preparing an attorney’s request. A demand for recalculation and payment of the outstanding amounts was sent to the military unit.
- Challenging the military unit’s refusal. Following a negative response, an administrative claim was prepared and filed in court.
- Substantiating the need for recalculation. The existence of legal grounds for applying the relevant year’s subsistence minimum for the period determined by the court was demonstrated.
After considering the case, the court accepted the arguments that the military pay calculations for the relevant period had been unlawful.
Outcome: the court ordered the military unit to recalculate and pay the outstanding amounts
The court declared the military unit’s incorrect salary calculations unlawful and ordered recalculation and payment of military pay for the period from June 18, 2025 to April 25, 2026.
The legal support secured a court ruling in the client’s favor and protected his right to receive the correct military pay.
