A client contacted the law firm “Prikhodko and Partners” with a request to provide full legal support during the disability determination procedure. The applicant has a chronic disease that has been progressing for more than five years and has recently caused a sharp deterioration in his health, limiting his ability to move and self-care.

The client contacted his attending physician with a request to initiate a referral procedure for an assessment of daily functioning (ADFM), but was refused. The doctor recommended contacting a family doctor, which forced the client to seek qualified legal support to avoid unlawful decisions and protect his rights.

Having studied the circumstances of the case, the validity of the grounds for undergoing the ECPF was established in accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 1338 dated 15.11.2024. It was also found that there was a need for additional examinations to confirm the violations of the body’s functions that affect the person’s ability to perform basic life activities: self-service, orientation, movement, communication, learning, behavior control and work.

Taking into account the results of the initial analysis, the lawyer initiated the submission of an electronic referral to the relevant healthcare institution authorized to conduct the assessment. The referral was processed by the administrator of the medical institution, who confirmed its acceptance and notified the client of the date, time and format of consideration of his case in the ECPF. The information was sent to the applicant’s email address, according to the protocol.
