Case: Establishment of the 3rd disability group for psoriasis through ETAEF
A client with a long-term chronic disease — psoriasis — approached the Prikhodko & Partners law company. The situation was complicated by the fact that the patient did not have a concomitant complication in the form of psoriatic arthropathy, which would significantly limit his daily activities.
At the time of contacting our medical lawyer, the client only had a consultative conclusion from a dermatovenereologist. Thanks to the timely intervention of our specialists, the client avoided a long bureaucratic circle of hell, protected his rights, and received a legal social status and a disability group.
Stages of legal support from “Prikhodko & Partners”
Legal services for the medical business and doctors, as well as legal assistance to patients in matters of establishing disability, require a deep understanding of updated legislation. Our lawyers implemented a clear strategy to protect the client’s interests.
1. Collecting evidence of the chronicity and severity of the disease
First of all, the medical lawyer helped the client officially record the clinical markers of the disease for experts. Documentary evidence of the continuously relapsing course of psoriasis was collected and systematized:
- documents indicating frequent exacerbations (our client had 4 medical visits over the last year).
- medical summaries confirming the affected skin area (the doctor recorded 60%).
- recording of the patient’s body resistance (tolerance) to previously administered therapy.
2. Undergoing additional specialized examinations (Orthopedist-traumatologist and Therapist)
Since the psoriasis lesions affected areas of skin on the foot, it caused problems with mobility. It was also recommended to undergo further examinations to record the presence of a concomitant disease — psoriatic arthropathy, which affects the joints.
The lawyers recommended and organized a comprehensive examination by an orthopedist-therapist. Based on the results of this examination, the following was clearly recorded:
- violation of functional parameters of mobility.
- a significant decrease in the person’s overall working capacity.
3. Obtaining the final conclusion of a dermatovenereologist
Based on the new clinical data, an expanded conclusion was obtained from the dermatovenereologist, where the specialist described in detail the violations of the patient’s key life activity criteria, namely:
- limitation of self-care ability (due to lesions of the skin and hand joints).
- limitation of the ability to engage in full-fledged labor activity (working capacity).
- moderate limitation of mobility.
4. Administrative support and interaction with ETAEF
Guided by the updated norms and requirements of CMU Resolution No. 1338, our company’s lawyers prepared a legal justification for the family doctor, after which the doctor seamlessly issued a referral to the commission. The entire package of documents was promptly compiled and submitted to the assessment body, and the medical lawyer provided full support at the commission.
Timeline and structure of case implementation
| Process Stage | What was done by the lawyers | Achieved result |
|---|---|---|
| Stage 1: Legal audit | Analysis of the existing dermatovenereologist’s conclusion, identification of gaps in recording life activity criteria. | A step-by-step strategy for further examination of the patient was developed. |
| Stage 2: Medical-legal collection | Organization of examinations by an orthopedist-therapist and updating the dermatovenereologist’s conclusion with the recording of limitations. | Limitations in the areas of “mobility”, “self-care”, and “working capacity” were documented and proven. |
| Stage 3: Submission and ETAEF | Claim work with the family doctor, compiling a dossier in accordance with Resolution 1338, support at the commission. | The case was reviewed by the expert team without remarks or demands for additional examinations. |
Final result for the client
Thanks to a professional approach and clear recording of medical indicators of functional disorders, the Expert Team for Assessing Everyday Functioning made an objective decision:
- The client was officially and without unnecessary bureaucracy assigned the 3rd disability group.
- The person gained access to legal social benefits, medical rehabilitation, and state support.
- Thanks to a properly built strategy for protecting patients’ rights, the client saved his time, energy, and completely eliminated the risk of receiving an unlawful refusal.
