Case: Obtained Licences for Urgent Medical Care and Patient Transportation for a Sole Practitioner
Opening a private urgent medical care service for a sole proprietor, namely an entrepreneur from the Lviv Region, became another successfully completed task for our medical lawyer.
The client’s objective was to enter the private emergency medicine market: to open a consultation office and launch a private urgent medical care and patient transportation service. The client’s business model required solving a range of legal matters: obtaining a medical licence for urgent care as a sole proprietor in the specialties of “Emergency Medicine” and “Paediatric Anaesthesiology”, as well as formally establishing the staff structure. It was important for the client to lawfully employ a paediatric anaesthesiologist, an emergency medicine physician and two emergency medical feldshers.
First, we met with the client and developed a step-by-step legal framework for licensing patient transportation and urgent medical care for a sole proprietor. We then proceeded with the project: turnkey legalisation of the business from the first submission to the Ministry of Health of Ukraine, without the risk of documents being returned or expensive equipment remaining idle.

Step 1. Legal structuring and selection of NACE (KVED) codes
For the private emergency medical service and transportation of bedridden patients, the following registration codes were selected:
- 86.21 — General medical practice;
- 86.22 — Specialist medical practice (the basic code for licensing emergency medicine and paediatric anaesthesiology);
- 86.90 — Other human health activities (a mandatory NACE (KVED) code for feldsher teams and mid-level medical staff).
Step 2. Pre-audit of the premises, accessibility and medical waste
Before signing the lease agreement for a 28 sq. m consultation office in Lviv, the lawyers reviewed the premises:
Building standards: the non-residential status of the premises, separate entrance and microclimate parameters were reviewed for compliance with DBN V.2.2-10:2022.
Accessibility for persons with reduced mobility: a certified expert was engaged and an official Accessibility Report for persons with disabilities was prepared.
Medical waste disposal agreement: legal support was provided in selecting an appropriate company, resulting in the conclusion of an agreement with a licensed company for the treatment of hazardous medical waste.
Step 3. Personnel audit of employed medical professionals
Under the current Licensing Conditions, a sole proprietor has the full right to employ specialist doctors and other medical personnel. The lawyers audited the team’s documents:
paediatric anaesthesiologist: diploma and valid specialist doctor certificate;
emergency medicine physician: diploma in “General Medicine” and specialist certificate in emergency medicine;
feldshers (2 persons): diplomas from professional medical colleges with the qualification “General Medicine” and valid certificates confirming completion of specialisation/professional development in the programme “Emergency Medical Feldshers”.
Step 4. Submission of the licensing file to the Ministry of Health
An application was prepared together with the Information on the Material and Technical Base and Staffing (Appendix 2 to the Licensing Conditions). The document package was signed by the client and submitted to the licensing authority.
Case result
The Ministry of Health published an order granting the sole proprietor an indefinite medical practice licence covering emergency medicine, paediatric anaesthesiology and general medicine.
FAQ: Frequently asked questions about licensing urgent medical care and patient transportation
1. Which licence is required for transporting patients: a transport licence or a Ministry of Health medical licence?
If medical transportation of patients is provided, meaning that the patient is under the supervision of a doctor or feldsher, connected to mechanical ventilation or oxygen, or requires medication support, this constitutes a type of business activity involving medical practice. A medical licence from the Ministry of Health of Ukraine is mandatory.
2. Can a sole proprietor employ feldsher teams and emergency medicine physicians?
Yes. Legislation allows a sole proprietor to employ doctors and healthcare professionals provided that their education and qualifications comply with the approved professional standards.
3. How much time is allowed for signing employment agreements with the declared employees?
Legislation establishes a clear deadline: no later than one month from the date on which the Ministry of Health decides to grant the licence. If a planned employee declines the position, the licensee must submit a notification of changes to the Ministry of Health within the same period.
4. Is it mandatory to own the premises?
No. Activities may be carried out in leased non-residential premises provided there is an official lease agreement and confirmation that the premises are accessible to persons with reduced mobility.
