Case: Helped the client to get the MCC certificate through support

Volodymyr T. turned to the lawyers of the company “Prikhodko and Partners” with a request to provide support during the preparation of the conclusion of the MAC, which is a document that confirms the need for care.

The client was assigned the third group with a term of 1 year, the cause of disability: a general eye disease.

Volodymyr’s illness is occupational. He has an FOP and actively conducts its activities. This work has a rather bad effect on his eyesight, since all the details of the activity require full responsibility, concentration and special care in the preparation of documents.

Since the diagnosis established by the doctors is progressing, despite the prescribed treatment, Volodymyr is forced to wear glasses to perform the mandatory types of work in his activity. However, even such a strain on the eyes causes him constant headaches and partial dizziness when walking, which makes it impossible to move independently and can even lead to loss of orientation in space and loss of consciousness.

Therefore, Volodymyr is forced to turn to his son for help, who partially takes care of him.

When the client consulted a family doctor at a medical institution to get a referral to a medical advisory board, he was rudely refused, because the complaints he mentioned did not, in their opinion, have grounds for providing MAC.

A lawyer practicing medical law analyzed the client’s situation in detail, assessed medical examinations/consulting opinions of doctors, circumstances and other factors that affect the success of obtaining a document confirming the need for care.

The client received a consultation on whether he has grounds for obtaining a MAC, the stages of registration of a MAC were discussed, his rights were explained, nuances and reasons for their occurrence were discussed.

After that, the lawyer of the company “Prykhodko and Partners” provided assistance in the collection and processing of documents, ensuring the completeness and reliability of the information provided.

Under the guidance of a lawyer, the medical examination forms were handed over to the Medical Advisory Commission (MAC), which is formed at a medical institution and makes decisions on providing recommendations for social care services at home and receiving social care services on a non-professional basis.

After agreeing on the results of the examination and signing the form by all members of the commission, the client visited the examination of the medical and advisory commission.

In turn, after conducting a review and analysis of the received documents, the MAC made a decision in favor of the client, thereby giving him a conclusion on the presence of a violation of body functions, due to which terminally ill persons cannot move independently and self-care and need social care services in a non-professional basis.
