Description of the client’s situation

Anastasia turned to the lawyers of the company “Prіkhodko and Partners” with a request – to register a disability of group II, due to a significant deterioration in her health over the past 2 years.

Anastasia has had the status of a person with a disability of group III since 2022 – lifelong. However, as of 2025, the degree of limitation of her vital activities became significantly pronounced, and did not respond to treatment in accordance with the rehabilitation program that was issued to her during the period of assigning the disability group III.

Thus, the client decided to seek advice from a medical specialist to find out whether she would be able to change the group that would correspond to her current state of health.

However, in response to her request, she received a verbal refusal. The medical specialist’s reasoning for the refusal: this disease and the criteria for limiting vital activity are not subject to the assignment of group II disability, and moreover, they can cancel the previous decision.

How did we help with the registration of group 2 disability?

Due to the doctor’s incompetence, as it seemed to the client, the latter decided to seek legal support and turned to us with a request for support at all stages of registration of disability of the appropriate degree.

Thus, in order to determine the probability of registration of group II disability and determine whether there is a correspondence between the disease and the criteria, a medical law lawyer with a forensic medical expert involved in the case, in the format of a consultation, an analysis of Anastasia’s medical documents was conducted in the period from receiving disability in 2022 to 2025. The results determined that this disease and the current state of health of the client correspond to the list of information provided for by the Resolution of the Cabinet of Ministers of Ukraine dated November 15, 2024 No. 1338.

Having agreed on the algorithm of actions for further cooperation, we continued to collect the entire necessary list of documents that could confirm the sharply negative course of the disease in the Patient.

Having carried out a re-analysis of the updated medical documentation, according to the electronic referral of the attending physician, which was formed in the electronic system, the documents were submitted to the healthcare institution that was territorially comfortable for visiting.

After some time, having received information about the form, date and time of the assessment, the client was consulted and prepared for the examination.

On the day of the assessment, the expert team made a decision to grant Anastasia the status of a person with a disability of group II and issued an extract from the decision of the expert team on the assessment of the person’s daily functioning.
