Case: Support in the process of registration of disability for a child who is abroad

The client (Victor) turned to the legal company “Prikhodko and Partners” for help with a request to provide support in the process of registering a disability for his minor son, who is abroad.

When Victor consulted a pediatrician at a medical institution to get a referral, namely advisory opinion of a specialist (form 028/о)- he received an unreasonable refusal, because the child is outside the country, and therefore granting the child the status of a disabled person is impossible.

A lawyer practicing medical law analyzed the client’s situation in detail, identified the problematic nature of the request, evaluated medical examinations/consulting opinions of doctors, circumstances and other factors that affect the success of obtaining the status of a disabled child.

Moreover, a lawyer prepared a request to the Ministry of Health for completeness information regarding the possibility of establishing a disability group for a child who is currently abroad and needs treatment on the basis of the specified medical conclusions.

Under the guidance of a lawyer, the medical examinations of the established appropriate form were handed over to the medical advisory commission (MCA), which is formed at the medical institution and makes a decision on assigning or refusing to assign a disability to a child.

Thus, after agreeing the results of the examination and signing the form by all members of the commission, the client received a decision in favor of the child, thus he was issued a medical report of a child with a disability under the age of 18 and was provided with an individual rehabilitation program for a disabled child.
