What was the client’s problem?

The complexity of this case was that the doctors did not see the patient as having grounds for assigning a disability group, and did not show a desire to submit documents for assessment, moreover, they did not provide an opportunity to record his current state of health in the complaints he expressed.

The lawyer analyzed the available medical documents in detail to determine whether the patient’s health condition actually met the criteria for establishing a disability group.

Then, a plan of examinations was prepared and recommendations were made for a specialist examination to ensure the completeness of medical documents for further registration of documents in accordance with the requirements of Resolution No. 1338.

In accordance with the recommendations provided, the client underwent a medical examination and received a doctor’s report confirming the impact of the disease, which significantly limits his vital activity in the appropriate degrees of its expression.

A specialist was selected as a lawyer, who reviewed all his medical information and properly prepared a package of documents for sending them to the medical institution.

The administrator of the EKOPFO medical institution accepted the documents and provided an invitation for an assessment with the specified date and time of the examination.

All details of the examination were discussed with the client, possible questions and answers to which it is worth preparing in advance.

Resolution 1338 stipulates that during the in-person consideration of the case for the assessment of the daily functioning of a person by an expert team at the request of the person in respect of whom it is being carried out, the following may be present: an authorized representative of the person (in particular, a lawyer, a legal representative).

Thus, the lawyer accompanied the client directly during the consideration by the commission, which ensured compliance with his rights and procedural guarantees.

According to the results of the commission’s assessment, the client was assigned the II disability group – lifelong, which confirms the correctness of the chosen legal strategy and comprehensive legal support.
