Formalizing permanent care for a person during martial law in Ukraine is a very relevant topic.

This is explained by the fact that in connection with the active hostilities on the territory of Ukraine, many citizens need outside help from other people due to the impossibility of taking care of themselves and taking care of themselves.

However, in practice, the question usually arises, what is needed to confirm the fact of continuous personal care?

In this informative article, we will try to answer this question and talk about why you need a certificate from the Medical and Social Expert Commission on the implementation of permanent care.

What is a Medical and Social Expert Commission certificate?

In Ukrainian legislation, a certificate of the Medical and Social Expert Commission is understood as a legal document that certifies the established degree of loss of working capacity of a citizen during his examination, as well as the presence of a certain disease that causes the onset of disability.

That is, the Medical and Social Expert Commission certificate entitles a citizen to apply to the relevant state authorities for one-time cash assistance and other social benefits provided for by current legislation in the event of permanent incapacity or designation of a disability group, as well as the possibility of receiving permanent third-party care from other persons.

Importantly! If you do not agree with the decision of the Medical and social expert commission regarding the establishment of a disability group or the determination of the loss of working capacity, then such a decision can be appealed to the regional or central Medical and social expert commission within 1 month. In this case, the commission is obliged to re-examine the citizen and make a new decision.

What is required to confirm the fact of providing permanent personal care?

As long-term care can be carried out for the purpose of business activity, as well as without the final result of receiving money, the documents to confirm the fact of ongoing care will be:

  • Certificate on receiving compensation for the provision of social care services on a non-professional basis - received in the social protection bodies of the population or TsNAP;
  • The act of establishing the fact of providing care- is obtained in district state administrations and executive bodies of village, settlement, and city councils based on the submission of a written application by a citizen to provide such personal care. Also, this document can be obtained in court;
  • Act of inspection of residence - together with other documents, confirms the real fact that the citizen provides permanent personal care.

Thus, on the basis of the Medical and Social Expert Commission certificate, the need for a person to receive third-party permanent care is established, and only then another package of documents is collected in order to confirm the fact of providing permanent care to a person due to an existing disability or loss of working capacity.
