Request:
The Client contacted the law firm “Prikhodko and Partners” with a question about obtaining an act of establishing the fact of providing care for his mother in order to be able to obtain a deferment from mobilization in accordance with clause 9, part 1, article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization”.
The Client, as the sole guardian of his mother, lives with her and provides her with constant care, helps with household matters, and monitors her treatment.
Decision:
The lawyers of our company conducted a thorough analysis of the case and documentation and confirmed that the Client is indeed entitled to receive an act of establishing the fact of providing care and a deferment on this basis.
Since the Client’s mother has a conclusion from the medical advisory commission (MAC) on the need for constant care, it was necessary to obtain an act of care.
The lawyer, together with the Client, prepared the necessary package of documents, including medical documentation, confirmation of cohabitation and family ties.
Furthermore, the lawyer prepared and submitted an application in the interests of the Client for the issuance of an act establishing the fact of care to the local department of social and veteran policy, after which a commission was held at the Client’s place of residence within ten days, establishing the fact of cohabitation and care for the mother.
Result: The Client was issued an act establishing the fact of care for his mother, which allowed the Client to exercise the right to a deferral under clause 9, part 1, article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization”.
