Case: Changing the child’s surname without the father’s consent in court
Lawyer: Anna Salienko
Lawyer: Sulyk Roman
Service: Changing a child’s last name without the father’s consent
Case No. 361/5492/24
The lawyer of the Prikhodko and Partners Law Company, Anna Salienko, was approached by a client who wanted to change her child’s last name, even though the biological father did not give his consent to such a change.
To ensure and exercise the right to change the child’s surname without the father’s consent, it was necessary to obtain a court decision on such a change.
After consultation and analysis of the case, lawyer Anna Salienko and lawyer Roman Sulyk, who acted as the plaintiff’s representative, brought the case to a positive decision.
The Brovary City and District Court of the Kyiv Region approved the Claim of the Client, in whose interests lawyer Sulyk Roman acted, regarding the change of the child’s surname – to satisfy.
Therefore, the court decided:
- Fully satisfy the mother’s claim
- Change the child’s last name
- Make appropriate changes to the birth certificate
Legal justification:
- The priority of the interests of the child
- Actual absence of father’s participation in upbringing
- Child’s psycho-emotional comfort
Important aspects that the court took into account when making a decision in our favor, in particular, but not exclusively, were that the child’s father has not actually participated in the child’s upbringing for more than 5 years. And the child, in turn, has the surname of the father, who shirks his parental duties
Complexities of the case:
- Proof of complete absence of father’s participation in education
- Justification of the psycho-emotional impact on the child
- The need to prove that the name change is in the best interests of the child
The strategy consisted in the fact that the lawyer Anna Salienko together with the Client gathered evidence of the long-term lack of contact between the father and the child, the lawyer prepared arguments about the psychological impact of the father’s surname and in the statement of claim emphasized the long-term maintenance and upbringing of the child by the mother.
Result:
- The claim was fully satisfied
- The child’s surname was changed to the mother’s surname
- Amendments have been made to the birth certificate
Conclusion: Successful protection of the child’s interests due to the change of surname.
