Case: TEMPORARY PROTECTION IN THE CZECH REPUBLIC AND THE RIGHT TO LEGAL EMPLOYMENT IN THE EU HAS BEEN OBTAINED

Problem and Desired Outcome: The client needed to obtain the right to work in the Czech Republic and documents for legal stay.
In December 2025, Danylo, a client, approached the Prikhodko & Partners Law Company with a request to process a work visa and a Temporary Residence Permit in the Czech Republic.
The client planned to obtain a residence permit through a company where he was one of the founders. However, during the analysis of the situation by our lawyers, it was established that the company through which the documents were planned to be processed did not comply with the requirements of the legislation of the Czech Republic regarding the right to employ foreign citizens and issue them employee cards.
Given the risks of being denied a Temporary Residence Permit and losing time, the lawyers at Prikhodko & Partners offered the client an alternative and completely legal mechanism for legalizing his stay — obtaining temporary protection in the Czech Republic.
During the consultation, it was established that the client:
- had not previously applied for temporary protection in other EU countries;
- had not been outside of Ukraine for an extended period;
- was actually in Ukraine as of the beginning of 2022.
To prepare the documents, our lawyers conducted a comprehensive analysis of the client’s situation and formed the evidence base.
Specifically, the following was done:
- an attorney’s request was filed to obtain a certificate of crossing the state border of Ukraine for the period from 2021 to 2026;
- documents were collected confirming the client’s presence in Ukraine as of the start of the full-scale invasion;
- support was provided for arranging a place of residence in Prague.
A separate stage was the preparation of a residential lease agreement, which, in accordance with the requirements of Czech legislation, had to be submitted to KACPU along with passport documents to obtain a temporary protection visa.
Upon arrival in Prague, the client received the signed lease agreement, the necessary applications were filled out, and documents were submitted to KACPU.
A positive decision was received on the very day the documents were submitted, and a temporary protection visa valid until March 27, 2027, was affixed to the client’s foreign passport.
After receiving the visa, the lawyers at Prikhodko & Partners, within the established three-day period, registered the client’s place of residence with the state authorities of the Czech Republic and fully completed the protection application procedure.
As a result, the client received:
- the right to legal residence in the Czech Republic;
- the possibility of free stay within the EU territory;
- access to the official labor market in the Czech Republic;
- legal grounds for further residence and employment.
Legal support on issues of migration and the legalization of stay abroad requires a detailed analysis of each situation and the correct choice of a legal mechanism. It was this timely legal assessment that allowed the client to avoid a rejection and successfully obtain temporary protection status in the Czech Republic.
