Case: Errors in the birth certificate were corrected, and changes were made to the civil registry record
Client: a Ukrainian citizen residing outside Ukraine who encountered an issue with a marriage registration record
Client’s Situation
A Ukrainian citizen contacted the Migration Law Department of Prikhodko & Partners. The client had been living abroad with his family for the past 10 years, and his only remaining connection to Ukraine was his citizenship.
During the review of his documents, discrepancies were identified in the personal information recorded in his marriage certificate. Specifically, his patronymic had been recorded incorrectly and did not match the information contained in the original birth registration record and his identity documents.
Legal Challenges and Objectives
The lawyers of our Migration Law Practice faced a complex task: not only to prepare the documents required to amend the civil status records but also to properly organize their submission, monitor the results of inquiries and database checks conducted by the Civil Status Registration Offices, and resolve the matter as quickly as possible.
The procedure was complicated by the fact that the law requires the applicant’s physical presence when submitting documents. Another difficulty was that the original marriage registration record was held in a different region of Ukraine, where power outages, air raid alerts, and other wartime disruptions were causing significant delays.
Acting under an attorney’s representation order, the lawyers of our Migration Law Practice successfully protected the client’s interests and secured the issuance of corrected documents.
Result
The lawyers of the Migration Law Practice at Prikhodko & Partners, acting on behalf of the client under the appropriate legal authority, successfully achieved the following:
- Amendment of the marriage registration record — correction of the incorrectly recorded patronymic.
- Amendment of the birth registration record — correction of an error concerning the place of birth.
- Obtaining the necessary documents from the Civil Status Registration Offices without requiring the client’s personal presence.
Most importantly, all necessary amendments to the civil status records were completed without the client having to be physically present in Ukraine. This made it possible to eliminate discrepancies in his personal documents and avoid the time and expenses associated with traveling back to Ukraine.
