Lawyer, Master of Laws, expert in the field of migration law. Legalization of stay in Ukraine, registration of residence permits, apostillization of documents.
A Ukrainian citizen contacted our law firm with plans to open a Thai massage parlor in Kyiv and hire Thai massage therapists. The client required full legal support, from business registration to legalizing the stay of foreign workers in Ukraine.
The goal is to quickly and completely legally launch a business with the possibility of officially employing foreigners.
During the support process, we worked in accordance with the following requirements:
Law of Ukraine “On state registration of legal entities, individual entrepreneurs, and public organizations”
Law of Ukraine “On employment”
Law of Ukraine “On the legal status of foreigners and stateless persons”
Rules for issuing type D visa
Order of the Cabinet of Ministers of Ukraine “On approval of the sample, technical description of the form and the procedure for registration, issuance, exchange, revocation, forwarding, confiscation, return to the state, invalidation and destruction of a permanent residence permit,” etc.
Registration of sole proprietorship
During the first stage, we discussed the optimal organizational structure for the client’s business with her. Considering the business model, tax burden, and ease of subsequent procedures, registering as a sole proprietor was chosen.
Our lawyers prepared all the documents, submitted them to the registrar, and supported the process until the sole proprietorship was included in the Unified State Register. We also advised the client on key economic activities (KVED) related to massage parlors and the beauty industry.
Preparing an employment contract with a foreigner
Since a key part of our business is the employment of Thai craftsmen, we developed employment contracts in accordance with legal requirements for foreign workers.
The contract was prepared in a standardized format accepted by the employment center, taking into account the terms of remuneration, work schedule, guarantees, and the employer’s responsibilities.
Obtaining a permit for the employment of foreigners
After preparing the contracts, we processed permits for the employment of foreigners.
Our specialists:
collected a package of documents;
agreed on qualification requirements;
submitted applications to the employment center;
received one-year permits.
These permits served as the basis for further visa processing.
Preparing documents for a D-04 visa
After receiving the permits, we prepared a complete package of documents for obtaining a D-04 visa at the Ukrainian Consulate in Thailand.
The package includes:
copies of work permits;
issued invitations from the employer;
employment contracts;
insurance;
instructions for employees on submitting documents to the consulate.
We also ensured communication with employees and provided step-by-step explanations regarding the visa application process.
We are expecting the arrival of foreigners to obtain a residence permit
Once their visas are issued, employees will be able to arrive in Ukraine and apply for a one-year temporary residence permit within the first 90 days.
We have already prepared a document checklist and are ready to assist the client and the foreigners during the permit application process at the State Migration Service office.
