Case: A ban on entry into Ukraine for a foreigner due to an unpaid fine for a traffic violation was lifted
Description of the situation
A foreigner married to a Ukrainian citizen contacted our company. The couple lives abroad and periodically visits Ukraine. During a recent attempt to enter the country, the client learned that he had been banned from entering Ukraine for a period of 3 years. He does not have any type of residence permit in Ukraine, so he crossed the border as a tourist.
The client did not understand the reasons for the ban, as he had never had any problems entering the country before.
Legal grounds for entry ban
According to Ukrainian law, an entry ban for a foreigner may be imposed in the following cases:
- violation of the rules of stay in Ukraine;
- evasion of compliance with decisions of Ukrainian state authorities (for example, non-payment of fines);
- having outstanding administrative penalties;
- threat to national security, public order, and public health;
- violation of traffic rules and failure to fulfill obligations related to being held accountable.
Stages of our work
- Request to the State Border Guard Service: We prepared a lawyer’s request to clarify the grounds for imposing the entry ban and to identify the authority that imposed it.
- Obtaining case materials from the State Migration Service: We contacted the Western interregional department of the State Migration Service and received copies of documents regarding the imposition of the ban.
- Establishing the real reason: It was discovered that the ban was imposed due to non-payment of a fine for violating traffic rules (Part 1, Article 122 of the Code of Ukraine on Administrative Offenses). The amount of the fine was 680 UAH.
- Request to the police: We submitted a request to the relevant police unit to obtain case materials/protocol and details for paying the fine.
- Payment of the fine: We paid the fine on behalf of the client, submitted confirmation and a lawyer’s petition for lifting the ban.
- Monitoring of execution: We monitored the crediting of funds, controlled the execution by the police, and repeatedly contacted the State Migration Service with a request to cancel the ban.
- Lifting of the ban by the State Migration Service: After receiving confirmation of the lifting of the ban, we contacted the border service to update their databases.
- Final check: We sent a final request to the State Border Guard Service – they confirmed the absence of an entry ban.
The client can now enter Ukraine again without any restrictions.
