Client Anna turned to the Prikhodko and Partners Law Office after the Seller (FPO) ignored her demands for a refund for undelivered goods.
In October 2023, Anna placed an order for sewing products in an online store. When placing the order, it was indicated that the payment is made to the bank account of the FOP. After placing the order, Anna wrote a FOP in the Viber application to clarify the data on the order and payment for the product. Anna paid for the goods to the seller’s account, after which the Defendant informed that the goods would be shipped within 2-3 working days.
Therefore, Anna and the Seller actually concluded a contract of sale of goods, according to which Anna was obliged to pay for the goods, and the Seller was obliged to send the goods to Anna within 2-3 days.
Three weeks later, Anna turned to the Seller with a demand to return the paid funds, since the goods were not sent. The seller requested details for a refund, but the funds were never returned.
Anna fulfilled her obligations under the contract, but the Seller did not. After that, Anna was forced to seek legal help to get the money back.
A lawyer from the “Prikhodko and Partners” law firm contacted the seller, sent him a pre-trial claim with the demand to return the money paid to Anna and the costs of legal assistance. The seller did not provide a written response, but three days after receiving the claim, he refunded Anna the full amount requested in the claim by bank transfer.
