Case: Helped a client keep his driver’s license after a traffic accident
Our law firm was contacted by a client who was faced with an unfair decision of the court of first instance. He was found guilty of causing a traffic accident without serious consequences – minor damage to another vehicle in the form of a scratched bumper.
Despite the fact that the circumstances of the case did not contain signs of a gross violation, the court imposed an excessively severe punishment – deprivation of the right to drive a vehicle for a period of 6 months.
Understanding the seriousness of the situation and its impact on the client’s future life, we immediately began preparing to appeal the decision.
Our strategy involved a comprehensive approach:
- Analysis of the case materials – we thoroughly examined all documents, the circumstances of the traffic accident and the available evidence, establishing that the sanction imposed by the court is disproportionate to the actual degree of the offense.
- Substantiation of the appeal – we prepared a legally sound position, focusing on the inconsistency of the punishment with the nature of the offense, as well as on judicial practice.
- Representation in the Court of Appeal – our team professionally defended the client’s interests, proving the need to change the punishment to a more fair one.
Thanks to our efforts, the Court of Appeal recognized the punishment as unreasonably severe and changed the sanction from deprivation of rights to an administrative fine. This decision allowed the client to avoid serious negative consequences and continue his usual life without significant restrictions.
Result: preservation of the driver’s license and minimization of legal risks.
Conclusion: in such situations, professional legal support plays a key role in ensuring a fair decision.
