Case: Successful client protection under Article 130 of the Code of Administrative Offenses
The client Serhiy turned to Prikhodko & Partners Law Firm (application 17.06.2025) to protect against unfounded accusations for an administrative offense under Part 1 of Art. 130 of the Code of Administrative Offenses (driving under the influence of alcohol) in Vinnytsia region.
The company’s lawyer prepared written explanations on behalf of the Client, and the lawyer represented his interests directly at the court hearing.
In the court of first instance, the lawyer drew the court’s attention to a number of significant violations by police officers, in particular:
- The police did not prove the fact that the Client was driving the vehicle at the time of the stop. There is no proper and admissible evidence of this in the case materials.
- The police acted biased and incorrectly. Their behavior indicated an interest in drawing up a protocol, and not in an objective clarification of the circumstances.
- The client did not deny that he was intoxicated and was examined on the spot.
- The police committed gross violations of the Instruction on the procedure for conducting an inspection and processing of materials. This casts doubt on the reliability of the recorded results.
- There is no complete and continuous video recording of the incident in the case materials. This makes it impossible to check the legality of the actions of the police and confirm the circumstances.
Despite the arguments given, the court of first instance did not take into account the explanations of the defense and found the Client guilty.
However, after preparing and filing an appeal, the employees of Prikhodko & Partners Law Firm managed to prove the groundlessness of the prosecution.
The Court of Appeal overturned the decision of the court of first instance and closed the proceedings in the case due to the lack of corpus delicti.
A positive result was received on 18.09.2025.
