Client Anton contacted the Prikhodko and Partners Law Office after a protocol was drawn up against him under Article 130 of the Code of Administrative Offenses.
On November 29, 2023 at 10:50 am Anton was in a parked car. At that moment, patrol police officers drove up to this car and began checking Anton’s documents. There were no grounds for such a check. Subsequently, the patrol police officer, who did not even provide his official ID for review and did not introduce himself, began to test Anton’s eye reaction to light without using a flashlight. Anton explained that the reduced reaction of his pupils was due to an eye disease. Considering these indicators, the police came to the conclusion that Anton was in a state of drug intoxication and offered to undergo an examination. Anton explained that he needed to go to work at the service station, after which he was ready to drive with the police officers. The police asked Anton to get behind the wheel at that moment and repark the car after they told him that they suspected that he was intoxicated.
The law office “Prikhodko and Partners” carried out an analysis of the case materials, after which an explanation was given to the court, from which it was clear that the police officers had committed a large number of procedural violations. The judge closed the case, found the Client not guilty, and the Client received his driver’s license back.
This case shows that in the event of procedural violations on the part of police officers, it is possible to bring the case to a positive result.
