Case: Refund of additional payment of 2,000 hryvnias to military pensioners
When implementing court decisions, the Pension Fund of Ukraine often neglects the rights of pensioners to a decent pension, does not satisfy their legitimate requests and unjustifiably reduces pensions. Thus, a military pensioner who served in the Armed Forces of Ukraine approached the Prikhodko & Partners law office with the following problem: during the recalculation of his pension by court decision, the Pension Fund deprived him of an additional payment of 2,000 hryvnias in accordance with Cabinet of Ministers of Ukraine Resolution № 713.
In order to solve this problem, we made a corresponding statement to the fund, where we pointed out the illegality of such a decision and demanded the return of this article of the person’s pension. We were refused in response. The refusal was justified by the fact that the client recalculated his pension in court and lost the right to state aid in the amount of 2,000 hryvnias. That is, from the moment of recalculation in June 2022, the person lost funds every month due to such a decision of the fund.
Disagreeing with such a refusal, our bureau appealed to the court with demands:
- Recognize as illegal the actions of the Main Department of the Pension Fund of Ukraine in Kyiv regarding the termination of accrual and payment of pension supplements in the amount of 2,000 hryvnias.
- Oblige the Head Office of the Pension Fund of Ukraine in Kyiv to calculate and pay a monthly supplement to the pension in the amount of 2,000 hryvnias.
The Khmelnytskyi District Administrative Court considered our claim and satisfied the requirements in full. When the decision came into force, we sent an attorney’s request with the demand to begin immediate implementation of the court decision by the fund. After considering this request, the pension fund began to implement the court’s decision.
Case № 650/21793/23 was considered by the court on 01/30/2024, the court’s decision entered into force on 02/30/2024, and already on 03/01/2024 the client began to receive a pension again in accordance with the letter of the law, taking into account an additional payment of 2000 hryvnias. In addition, the military pensioner was charged a debt in the amount of 23,610 hryvnias, which must be paid by the pension fund for its inactivity. Thus, it was possible to achieve full restoration of our client’s rights.
