The client Maryna turned to the law firm “Prykhodko and Partners” for help, as she was handed an act of non-fulfillment of the official duties assigned to her by the employee. The lawyer familiarized himself with all the circumstances of the situation and made a written explanation of the situation to the client – since such explanations must be provided by the employee during the disciplinary proceedings and must be taken into account when the employer (or his authorized body) makes a decision on the application or non-application of disciplinary sanctions.
To help the client, all the details were studied, while studying the circumstances, we determined that the client was transferred from one position to another, but did not make appropriate changes to the employment contract regarding the scope of duties and was not familiarized with the job description of the new position, which and was used in the justification of explanations.
The client submitted an explanation to the employer for consideration, and the latter, after studying the rationale, offered to negotiate with the employee to resolve the issue peacefully.
