Case: Protected the interests of the Tender Customer from an unfounded complaint by a procurement participant

The Customer in the field of public procurement (Prozorro) applied to the legal company “Prikhodko and Partners”. The customer canceled the auction for legal reasons, namely for the reasons of reducing budget expenditures. Considering such a decision illegal, one of the Participants filed a complaint with the Antimonopoly Committee of Ukraine (hereinafter – AMCU), asking to cancel the Customer’s decision to cancel the bidding.

Dmytro Zal, a lawyer at the “Prikhodko and Partners” law firm, on behalf of the Customer, prepared written explanations for the AMCU commission for handling complaints and represented the interests of the Customer in the tender at the commission meeting.

The Commission for Review of Complaints of the Antimonopoly Committee of Ukraine recognized the arguments of the Customer’s representative as well-founded and found no grounds for satisfying the complaint of the Public Procurement Participant, confirming the legality of the cancellation of tenders.
