In October 2023, a client contacted the “Prikhodko and Partners” law office with the help of a lawyer in criminal proceedings.
He was charged with smuggling narcotic drugs, which he ordered for personal use abroad and received by mail. The client was also accused of possession of narcotic drugs without the purpose of sale, i.e. of committing criminal offenses provided for in Part 2 of Art. 305 and Part 1 of Article 309 of the Criminal Code of Ukraine.
The main task assigned by the Client to the lawyers is the quick completion of the case in order to get out of this stressful situation and, of course, with the minimum possible punishment.
Taking into account the fact that the fact of the commission of offenses was sufficiently well documented by the law enforcement officers, a strategy of business remorse was chosen, i.e. admission of guilt and cooperation with the prosecution. As a result of the implementation of the strategy proposed by the lawyer, it was possible to reach agreements with the prosecution, which were formalized in the form of a plea agreement.
As a result, already in July 2024, a sentence was passed on the basis of the agreement, and the Client received a penalty in the form of a fine instead of imprisonment – in the case of drug smuggling (Part 2 of Article 305 and Part 1 of Article 309 of the Criminal Code of Ukraine)!
