For a victim, an extract from the Unified Register of Pre-Trial Investigations (ERDR) is a document that confirms the very fact that information has been entered into the register, the legal classification of the crime, the date of initiation of the proceedings, and the pre-trial investigation authority. Without it, it is difficult to move forward: to prepare motions, appeal against an investigator’s inaction, or build a strategy to protect one’s rights.
A client approached the Law Firm “Prikhodko and Partners” with precisely this request. The client had been recognized as a victim in criminal proceedings. The case was under the jurisdiction of the Security Service of Ukraine, and the client was unable to obtain the extract independently.
Procedure for Obtaining an ERDR Extract
- Consultation and analysis of materials. At the first meeting, we collected complete information: copies of applications, available responses, and the client’s procedural status. This allowed us to formulate a precise legal position and determine which legal provisions to rely on.
- Preparation and submission of an адвокатський запит (lawyer’s request). The lawyer’s request was sent to the Security Service of Ukraine as the pre-trial investigation authority. The document clearly stated the grounds for the request, the client’s status as a victim, and the obligation to provide the ERDR extract.
- Receipt of an official response. Authorized officials reviewed the request within the statutory time limits and provided a response along with a copy of the ERDR extract. The client received a document confirming the registration of the criminal proceedings, enabling further protection of their rights at the next stage.
In practice, refusal or delays in providing the extract are common issues. Formal grounds, incomplete responses, and redirection of requests between authorities all consume time and create the risk of losing control over the case.
