At the end of 2022, the “Prikhodko and Partners” law firm was approached by a military serviceman who, due to certain circumstances, was involuntary desertion of the military unit (SZH).
The main task assigned to the law office by the client was to minimize the punishment.
The client was given recommendations for a medical examination and treatment of diseases that worsened during military service. In addition, in the course of a pre-trial investigation into the fact that a military serviceman had committed a criminal offense (Part 5, Article 407 of the Criminal Code), a re-exam was initiated.
As a result, the state of health of the military serviceman was taken into account by the prosecution and a plea agreement was offered with a specified punishment of 2 years of service limitation, which is the lightest possible punishment for voluntarily leaving a unit or battlefield during martial law.
