At the beginning of June, a military serviceman who took a loan from an MFI applied to the problem debt department. At the time of contacting the lawyers, the serviceman had accumulated a significant amount of interest, which made it much more difficult for him to fulfill his obligations to the microfinance institution. The amount of debt was relatively small to consider the bankruptcy procedure, so our lawyers, having found out the fact that the client is a military serviceman, began to act in accordance with Article 14 of the Law of Ukraine “On Social and Legal Protection of Military Servicemen and Members of Their Families.” So, at the time when our client was risking his life on the front line, lawyers Ilya Kolesnyk and Anastasia Shakhovets solved his problem.
According to the current legislation, military personnel are exempt from paying fines, penalties and interest for using loans. This right is guaranteed by Part 15 of Art. 14 of the Law of Ukraine “On Social and Legal Protection of Servicemen and Members of Their Families”.
The lawyers prepared the appropriate package of documents confirming the client’s mobilization and applied to the financial institution with a written demand for interest write-off.
As a result, our client was charged all accrued interest during the period of mobilization.
